FilingChamps Private Limited is a registered Trust & Corporate Services Provider. As a client availing FilingChamps services, you agree to the following terms and conditions:
Goods and Services Tax (GST) is applicable to our fees. A GST e-Invoice and Input Tax Credit will be provided if you provide GSTIN at the time of payment. It is the client’s responsibility to ensure GSTIN is provided at the time of payment to receive GST Input Tax Credit.
Any additional government fees associated with incorporation, licenses, or trademark services, where applicable, will be notified upfront in the invoice, collected, and subsequently remitted to the respective governmental authority.
1) Terms & Conditions Governing the Usage of FilingChamps.com
Welcome to FilingChamps.com. This website is owned and operated by FilingChamps Private Limited, located at 3rd Floor, 89/91, Dhanji Mulji Building, Old Hanuman Lane, Kalbadevi, Mumbai 400002. By visiting our website and accessing the information, resources, services, products, and tools we provide, you agree to accept and adhere to the following terms and conditions (referred to as ‘User Agreement’), along with the terms and conditions outlined in our Privacy Policy (refer to the Privacy Policy section for more details).
We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement to the modified terms and conditions.
RESPONSIBLE USE AND CONDUCT
To access our Resources, you may be required to provide certain information about yourself (such as identification, email, phone number, contact details, etc.) as part of the registration process or to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date.
You are responsible for maintaining the confidentiality of any login information associated with any account you use to access our Resources. Accordingly, you are responsible for all activities that occur under your accounts.
Accessing (or attempting to access) any of our Resources by any means other than those we provide is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical, or unconventional means.
Engaging in any activity that disrupts or interferes with our Resources, including the servers and/or networks to which our Resources are located or connected, is strictly prohibited.
Attempting to copy, duplicate, reproduce, sell, trade, or resell our resources is strictly prohibited.
You are solely responsible for any consequences, losses, or damages we may directly or indirectly incur or suffer due to unauthorized activities conducted by you, and you may incur criminal or civil liability.
We may provide various open communication tools on our website, such as blog comments, blog posts, public chats, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that we do not pre-screen or monitor the content posted by users of these tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your responsibility to use these tools ethically. By posting information or using any open communication tools, you agree that you will not upload, post, share, or otherwise distribute any content that:

We have the right at our sole discretion to remove any content that does not comply with this User Agreement, or any content that we deem offensive, harmful, objectionable, inaccurate, or that violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we remove, you consent to such removal and waive any claim against us.
We do not assume any liability for any content posted by you or any 3rd party users of our website. However, any content posted by you using any open communication tools on our website, provided it does not violate or infringe on any 3rd party copyrights or trademarks, becomes the property of FilingChamps.com, and grants us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display, and/or distribute as we see fit. This applies only to content posted via open communication tools and does not refer to information provided as part of the registration process, necessary to use our Resources. All information provided as part of our registration process is covered by our Privacy Policy.
You agree to indemnify and hold harmless FilingChamps Private Limited and its directors, officers, managers, employees, agents, and licensors from all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or failure to fulfill any obligations related to your account incurred by you or any other person using your account.
PRIVACY
Your privacy is very important to us, which is why we’ve created a separate Privacy Policy to explain in detail how we collect, manage, process, secure, and store your private information. LIMITATION OF WARRANTIES
By using our website, you understand and agree that all resources provided are “as is” and “as available.”
LIMITATION OF LIABILITY
Any claim against FilingChamps shall be limited to the amount paid, if any, for use of products and/or services. FilingChamps will not be liable for any direct, indirect, incidental, consequential, or exemplary loss or damages incurred as a result of using our Resources or due to any changes, data loss, corruption, cancellation, loss of access, or downtime, to the extent permitted by applicable limitation of liability laws.
COPYRIGHTS / TRADEMARKS
All content and materials available on FilingChamps.com, including but not limited to text, graphics, website name, code, images, and logos are the intellectual property of FilingChamps Private Limited and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to reproduction, distribution, display, or transmission of any content on this site is strictly prohibited unless authorized by FilingChamps Private Limited.
TERMINATION OF USE
We may suspend or terminate your access to all or part of our website and Resources without notice if you breach this User Agreement. Any illegal, fraudulent, or abusive activity may result in termination and referral to law enforcement authorities.
GOVERNING LAW
This website is controlled by FilingChamps Private Limited from our office in Mumbai, India. By accessing our website, you agree that the laws of India, without regard to conflict of laws, will apply to all matters relating to the use of this website and the purchase of any products or services.
CANCELLATION AND REFUND
Cancellation of orders is not possible once the payment has been made. No refunds will be given except for non-performance of services by FilingChamps Private Limited.
GUARANTEE
Unless otherwise expressed, FilingChamps.com expressly disclaims all warranties and conditions of any kind, whether express or implied, including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.

This document outlines the terms applicable to the use of FilingChamps services. By accessing our website, mobile applications, or availing of our services, you agree to these terms and consent to the collection and processing of personal information as outlined in our Privacy Commitment.

Refund and Cancellation Policy
We offer a 30-day satisfaction guarantee. Refunds after 30 days will be in the form of service credits. Cancellations will incur a 20% fee, along with any earned fees. Refunds are subject to a maximum of 80% of the total paid amount.
Change of Service: You can change services after 30 days. The original purchase price, minus earned fees, will be credited towards the new service.
Requesting a Refund: Initiate a refund via our support chat or email us at contact@filingchamps.com. Refunds typically take 3-5 weeks to process.

We may update these terms and encourage you to review them regularly.

3) Terms & Conditions for Incorporation, Startup, and Registration Services
- Bank Account or Payment Services: With your consent, we will share your name, phone number, and email with the bank of your choice. The bank reserves the right to approve or decline your request based on its policies.
- Partnership Firm Registration: Additional charges apply for Partnership Firm registration with the Registrar of Firms in respective states. These charges will be communicated upfront.
- Name Approval: Up to 4 name options can be submitted in one RUN name approval request for company registration.
- Authorised & Paid-Up Capital:
- Authorised capital refers to the maximum shares a company can issue, which can be increased as needed.
- Paid-up capital is the actual investment from shareholders, which can be as low as ₹2.
- Statutory Auditor Fees: Statutory Auditor fees must be paid directly to the Independent Auditor appointed by the company’s Board of Directors. Companies are required to appoint an Independent Statutory Auditor within 30 days of incorporation.
- DSC Hyper Token & KYC Support: FilingChamps provides 2 DSC Hyper Tokens and support for KYC and DSC shipping with each incorporation. As per CCA guidelines, effective 15th July 2024, payments for DSC certificates and KYC must be made directly to the Certifying Authority.
- Additional Authorised Capital: If additional authorised capital is required at incorporation, its price will be provided upon request.
- Stamp Duty Charges: Clients are responsible for paying stamp duty, which varies based on the state of incorporation and the company’s registered capital. Detailed lists of stamp duty charges per state and capital range are available upon request.

Pricing
Unless explicitly mentioned otherwise, prices are quoted for one class only. Additional classes will incur extra charges. -
Trademark Name Recommendations
FilingChamps or its employees will not provide recommendations regarding names for trademark filings, nor can we confirm the availability or guarantee the successful registration of any trademark. -
Client Responsibility for Information Accuracy
It is the sole responsibility of the client to verify and ensure the accuracy of the information provided in trademark forms. FilingChamps disclaims any liability for incomplete or inaccurate information supplied by the client. -
Objections, Refusals, and Oppositions
FilingChamps cannot be held responsible for any objections, refusals, oppositions, or other issues arising during the trademark registration process. The client understands that such matters are beyond FilingChamps' control. -
Trademark Registration and Acceptance
FilingChamps cannot guarantee that the trademark will be accepted or registered by the Trademarks Office or through the objection reply process. Acceptance and registration of a trademark are at the discretion of the Trademarks Office. FilingChamps will make reasonable efforts to assist the client, but final approval is not guaranteed. -
Tracking Trademark Application Status
The client is responsible for tracking the status of their trademark application via the IP India portal. FilingChamps may provide assistance or guidance upon the client’s request. -
Show Cause Hearings and Objections
FilingChamps will not be held liable for Show Cause Hearings or other issues that may arise during the objection process. The client acknowledges that such matters are beyond the control of FilingChamps. -
Client Data Confidentiality
FilingChamps will ensure the confidentiality of all client data. However, in cases where disclosure is mandated by a court, administrative agency, or other governmental body, FilingChamps will comply as required by law.
5) Terms & Conditions for Refunds and Cancellations
At FilingChamps, we take pride in delivering exceptional services and aim to ensure your satisfaction with our offerings. We continually improve and strive to provide the best accounting, financial, and secretarial services. However, if you are not satisfied with our services, please contact us immediately, and we will take appropriate steps to resolve the issue, provide a refund, or offer credit for future services.

If you’re not satisfied with the service provided, log into our Client Portal and create a ticket for the engagement to initiate the refund process. Our Senior Management team will review all help tickets and personally respond within 24-48 hours.
Refund Policy
Upon making a payment to FilingChamps, the fees are held in a client account and earned incrementally as we work on your case. FilingChamps earns fees at different stages depending on the progress made, such as assigning a relationship manager, providing client portal access, obtaining DIN, filing forms, etc. Refunds cannot be provided for the earned portion of the fees, as they reflect the time and resources spent on the service.
Refunds are not available for payments made to government entities (e.g., filing fees or taxes) or third parties involved in processing your order. Under any circumstances, FilingChamps will refund only up to the amount of the fees paid by the client, minus any earned fees.
Procedure for Requesting Refund
Refund requests must be initiated through the Client Portal by signing in and requesting a refund in the relevant engagement chat room. All refund requests must be made within 60 days of purchase. Requests made after 60 days are ineligible for a refund but may qualify for a credit toward future services. Refunds will be processed within 4 to 5 weeks upon receiving all the necessary information, including the reason for the refund and bank details.
Change of Service
Clients may request a change of service within 60 days of purchase. The amount paid for the original service, minus any earned fees and payments made to government entities, will be credited to your FilingChamps account. The credited balance can be used for other services provided by FilingChamps.
Standard Pricing
FilingChamps maintains a standard pricing policy, meaning no additional service fees will be charged under any circumstances, except for an increase in government fees or fees related to re-filing of forms due to rejections or legal documentation completion. FilingChamps is not responsible for other costs the client incurs to complete the service.
Factors Outside Our Control
We cannot guarantee the outcome of any government-related processes (e.g., trademark applications or other filings), as legal reasons beyond FilingChamps’ control may affect these outcomes. Delays caused by government backlogs or platform issues (e.g., MCA website, Income Tax website) are not eligible for refunds. Services rendered by our Associates via the Nearest.Expert platform, who are not employed by FilingChamps, are also outside of our guarantee.
Force Majeure
FilingChamps will not be held in breach of its satisfaction guarantee or default of service obligations due to circumstances beyond our control, including natural disasters, legal changes, war, terrorism, strikes, and other Force Majeure events.
Cancellation Fee
Since FilingChamps incurs costs for time, manpower, and resources, refunds are limited to satisfaction issues caused by FilingChamps—not changes in your situation. If a client requests to hold service, we will retain the paid fee until the client is ready to proceed.
If you are not satisfied with our service, a cancellation fee of 20% plus earned fees and government fees will apply before processing any refund. If the service is changed instead of canceled, the cancellation fee will not be applied.
